1.0 Payment will be 50% at the beginning and 50% after rendering. (before delivering the complete artwork). The customer can choose to pay 100% in advance.
↳ 1.1 There will be no 100% refund at any stage, there will only be a percentage refund upon delivery of the artwork.
↳ 1.2 Until the color and lineart stage, the client can receive 70% of the amount paid instantly.
↳ 1.3 During the rendering phase, the client can receive 30% of the amount paid instantly.
↳ 1.4 After the completion of the comms, the client will not be entitled to a refund.
↳ 1.5 If the artist needs to cancel the comms, she will have a 100% refund without delivery of the art.

2.0 Payments via Nubank, Pix and Picpay.
↳ 2.1 Another form of payment will be denied.
↳ 2.2 For any trade suggestion, the artist must be notified during the order information and description, which may or may not be accepted

3.0 Only USD

4.0 The comms will only be made/continued after the customer's approval/payment, if not done, another order will go ahead.
↳ 4.1 The customer will have the right to wait 30 days to make the initial payment, after this wait and without agreed payment the comms will be canceled

5.0 Prices may change depending on the complexity of the order.

6.0 The artist works in phases: Sketch, Color + Lineart, Render.
↳ 6.1 The client can change as many times as they want in the sketch phase.
↳ 6.2 Until the render phase, the client can only change the colors or details that were not noticed or the artist made an error.
↳ 6.3 In the other phases, it can only be changed with an extra price depending on the complexity.

7.0 The artist is expected to take up to 3 months to complete a comm. There is a Trello page where all customers can check their position in the queue.
↳ 7.1 If the artist started her comm, It's your right as a customer to ask how it's going. But do not press to finish if a deadline was not discussed.
↳ 7.2 After 3 months and there is no completion, the customer is entitled to a 100% refund without artwork or a percentage refund with what was made of the artwork.

8.0 If the customer wants their comms to be made faster, they must pay $20. $50 if a vtuber model. $80 for Vtuber Package
↳ 8.1 When you pay the fee, the order will start the next day.
↳ 8.2 The artist rarely works exclusively with people who have never worked before or on large jobs.

9.0 The artist will inform you if there are events that may delay the comms.

10.0 For confidentiality, include one of the following packages:
↳ 10.1 Package 1 ($ 5): Only WIP will be posted, final file only with authorization.
↳ 10.2 Package 2 ($ 15): No WIP, final file only with authorization.
↳ 10.3 Package 3 ($ 30): TOTAL confidentiality, abbreviated name on trello.

11.0 The personal information of both the artist and the client cannot be shared or used in good or bad faith, as well as the plans that do or do not involve the order that was placed

12.0 The artist must receive model credits with @ included from twitter/X.
↳ 12.1 This could be in video/live descriptions or bios and profile descriptions on social media with a link to twitter/X.
↳ 12.2 All work done by Aisha Qmuy must be credited in the best way possible

13.0 The artist has the right to post comms on social networks, portfolios, tutorials, live streams, demonstrations, etc... (following the rules of secret comm packets)

14.0 Informing the request does not guarantee that the artist will accept it, it may be denied for personal reasons.
↳ 14.1 The artist will inform the reason if she deems it necessary.
↳ 14.2 Certain types of comms will only be made if the buyer, character and performer (vtubers) are over 18 (any concealment of this information will not be the responsibility of the artist)

15.0 Keep in mind that the artist improves her design/painting style. So what you saw in the portfolio/prices may be different from what it currently does

16.0 Requests that do not have a suitable reference sheet will not be accepted.

17.0 During the order, the artist has the right to replicate the design of her character.
↳ 17.1 After that, the artist will not have the right to sell any art involving the design without permission from the owner.
↳ 17.2 The artist will not have the right to edit or use your .psd for training without your permission (example: training for rendering, rigger or anything that changes the original file)

18.0 The finished comms will be sent via Google Drive link or E-mail.
↳ 18.1 For illustrations, png will be sent with signature, with and without background.
↳ 18.2 Vtubers model will be sent .psd ready for rigging, png of their possible looks and expressions.
↳ 18.3 Design Category will be sent separately to the versions.

19.0 The artist provides you with the service of "Free Adjustments and Edits" for Vtuber Models and separate arts provided by them.

20.0 The artist has a blacklist with riggers who refuse to work together for personal reasons, the list will be sent together with a .psd of the model or separate art.
↳ 20.1 Working with these riggers makes the client lose the right to "Free Adjustments and Edits"

21.0 Agencies, companies and other organizations will have changed values.
↳ 21.1 Agents and affiliates who place orders that do not involve company projects will not have changed values.

22.0 Gift illustration will be a Surprise Me art, which can be an icon or halfbody at the artist's choice.

23.0 Surprise Me arts are made without supervision from the client, without revisions and spoilers until completion.
↳ 23.1 If an error occurs, which could be related to the design, changes will be made free of charge

24.0 All conversations will be carried out via social media messages that are agreed between the client and the artist.
↳ 24.1 Any prejudice, offensive speech, disrespect and excessive discomfort will cause the service to be terminated.

25.0 Customer's request will be removed from trello and archived if no news is received within 2-3 months.
↳ 25.1 Customer can return for refund

26.0 The artist is open to feedback on behavior, organization and delivery, but refuses NEGATIVE feedback/opinions that dictate about his art without asking the client and those involved (painting, lineart, anatomy, etc...)

27.0 The artist will communicate about the start of the comms and whether the client is still interested, if they do not respond within 1 week, maximum 2 weeks, the comms will be understood as "not interested" and will be removed from the waitlist

28.0 The artist speaks native Portuguese and intermediate English, but if she deems it necessary, a translator will be used

29.0 You do not have the right to trace, copy and claim that you made my art.
↳ 29.1 You will not be able to remove my signature.
↳ 29.2 You may not change it or ask someone else to do it without my permission.
↳ 29.3 You cannot use it in AI, NFT and other programs for the same purpose.
↳ 29.4 You cannot ask another artist to copy my work for any reason.

30.0 The client does not have the right to sell or resell the original file delivered.
↳ 30.1 They may only do so with prior notice to me and agreed-upon licenses or agreements.

31.0 Monetized Use is charged at 50% of the total commission value and 80% of the total value for merchandise.
↳ 31.1 Monetized Use will be charged if the work is used in live streams (such as banners, background art, etc.), promotions, events, or any involvement with monetized content creation.
↳ 31.2 Merchandise Use will be charged for the sale of physical and digital products containing the artwork (keychains, mugs, pillows, prints, wallpapers, buttons, subscriber rewards, etc.).
↳ 31.3 For companies and agencies, the value will be 100% of the total commission value, and there will be an agreement for at least 10% of the sales of products containing the artwork.
↳ 31.4 Any other license the client wishes to acquire must be discussed for agreements.

32.0 VTuber models and designs already include the right to Monetized Use.
↳ 32.1 VTuber models and character designs give you the right to use them as a reference for creating products, but do not give you the right to sell the original file created by the artist.

33.0 Illustrations Surprise Me may have its original files used as a reward on Patreon
